Significance Of Recruitment And Selection Business Essay Recruitment and selection process in an organization is important in order to attract an effective workforce. This is important because it would determine the business success and would affect the whole organization operation. One of the most valuable assets in an organization is the employees. Recruitment is defined as the process of attracting individuals on a timely basis, in sufficient numbers, and with appropriate qualifications, and encouraging them to apply for jobs with an organization (Mondy Noe, 2008). There are two main stages of recruitment. Firstly, strategic planning is needed to define the objectives and goals of the organization. Next, human resource planning is needed to identify the whether there are surplus or shortage of workers or just enough workers to achieve the organizational goals. The objective of recruitment is to attain the number and quality of employees that can be chosen to help the organisation achieve its objectives and goals. It also helps to create a pool of potential employees for the organisation in order for the management to select the right applicant for the right job. Selection is the process of choosing from a group of applicants the individual best suited for a particular position and organization (Mondy Noe, 2008). The vital goal of selection is to hire the candidate who is most suitable for the job duties and the culture of the organization. Using the right selection methods and delivering them effectively is important. Outsourcing is when the organization uses an external company to perform task and function of the organisation. Contingent workers are also known as temporary workers, part-time workers and just-in-time workers. When there is not enough full-time employees to complete some task, using contingent workers is a good choice. Professional employer organisation is companies that lease out their employees to organisations for a certain period. Overtime is when employees work for extra hours to deal with a large workload that is temporary. This way organisations save money on recruiting, selecting and training new employees. 2.1 Recruiting methods Recruitment source is the place where qualified individuals are found (Mondy Noe, 2008). Recruitment method is defined as the ways in which potential employees are attracted to an organisation (Kleynhans, 2006). Internal recruiting methods are employee database, employee referrals, job posting and job bidding. Employee database is able to show the organisation whether current employees have the required qualifications for filling the vacancies. Furthermore, an employee referral is when employees mention someone who is capable and suitable for the job opening to the recruiter. Job posting is a procedure of letting employees know there is a job vacancy whereas job bidding is a procedure that employees who believe that they possess the required qualifications to apply for the vacant position. There are several external recruiting methods. The methods commonly used are media advertising, job fairs, internships and employee agencies. Media advertising is a popular method. The organisation can put up its employment needs through various advertising means such as newspaper, internet, radio and television. Other than that, job fair is a recruiting method used by employers to attract large number of applicants to one location for interviews. Internship is where students are hired by an employer for a period of time into professional or technical position that relates to their area of study and prepare them for the workforce (Internship Definition, 2008). Employee agencies are organisation that aids to recruit employees and also help individuals to find for jobs. 2.2 Selection process The first step of selection process is preliminary interview. This step is to eliminate obviously unqualified candidates. The HR manager can conduct this step via telephone, video or virtual job interview. Telephone interview is commonly used as it saves time. The next step in selection process is review of applications and r à ©sumà ©. Evaluation of the applications of employment is done by the employer to determine whether the applicant is suitable for the position. Subsequently, the organization will administer some test such as work sample, job knowledge, psychomotor abilities test, vocational interest, and personality. Work sample test is used to test the ability of an individual to perform task that represent the job itself. Job knowledge test are used to test the applicants knowledge on duties of the job applied. Psychomotor abilities test assess the strength, coordination and agility of the applicant. Vocational interest test are used to test ones satisfaction or interest on the occupation. Personality test measures trait, temperaments and characters of the applicants. Employment interview is the oral examination of candidates for employment. The employer will exchange conversation with the applicants to evaluate them. There are two types of interview; structured and unstructured. Structured interview ask about questions related to the job whereas unstructured interview ask open-ended question. There are also four methods of interviewing which are one-on-one, group, broad and multiple interviews. Following the employment interview, investigation of the applicants background and reference are done to determine the truth of information stated. Previous employment, education verification, criminal history and personal reference check are some elements to verify. Next, selection decision is conducted. This is the most crucial step in the process. Candidate with the best qualification would be recruited by the organization. Lastly, medical examination is administered to see whether the candidate is physically capable to execute the job functions. If the applicants pass the whole process successfully, they will be notified to commence work as soon as possible. 2.3 Significance of Recruitment and Selection Recruitment and selection process is important for an organization to achieve its goals. Besides, it is time consuming, the employers may meet a lot of unqualified employees and it may take some time to filter the unqualified employees. 3.4 Selection Process After the recruitment process, Public Bank will undergo selection process. Selection means choosing the best individual best suited the particular position in Public Bank from a group of qualified applicants. Public Bank want to make sure that the applicants is properly matched with jobs and organization by selection process. The selection process in Public Bank is done step by step after Public bank recruited qualified people throughout the selection methods. The first process is preliminary interview. The main objective Public bank do this process is to eliminate the obviously unqualified individuals. Public bank will phone the candidates recruited to have a telephone conversation. Phone call will not cost Public Bank as much as compare to face-to-face interview and effort of interviewer. It is also a way to test for the verbal skills by having tele-conversation. If the applicants cannot perform well in tele-conversation, for sure they will also not perfom well during face-to-face interview which require higher verbal skills include body language, eye contact and movement. Increase efficiency Applicants will be given a selection tests. All the results obtain from the selection test will be standardize and uniform. Hence, it will be faster during make comparison between applicants, directly increase the efficiency of selection process. Other that, structure interview also will increase the efficiency of selection process because the question is similar for the entire applicant such as introduce yourself. By this, interviewer will have a best formal answer and determine which applicant will give the answer most close to the formal answer. Increase reliability and accuracy Public Bank will have a background and references checks after face-to-face interview with the applicants. They want to make sure that information given by applicants is not fraud and certificates and documents submitted are recognized by the issuing units. Once the issuing units confirmed the certificates and documents thus prove the applicants have the qualification with proper education background. If records are not found when refer to the issuing units, thus can eliminate the applicant to prevent organization hire the unqualified worker. Disadvantages of the practice of Selection methods in H.R management Interviewer may have bias to certain group of people Public Bank is using one-on-one interview method. This method is quite inappropriate when the interviewer is biased to certain group of people. The performance of applicants is very subjective due to the perspective of the interviewer. For example, when the interviewer believe that man will perform better in banking industry compare to woman, no matter how well the women performance during the interview or having higher education of that area, having more experience, she will still not been selected because of the point of view of the interviewer. This may cause Public Bank lose a better worker thus directly reduce competitive advantage. Time consuming Public Bank want to increase reliability and accuracy but in another hand waste time. To check for the validity of certificates and documents, the issuing units need time to proceed. While waiting for the feedback from issuing unit, applicants may search for other jobs. Once they found the information given by selected applicant is fraud, they need to select another applicant and go through this process again. Besides that, by having one-one-one interview method, it takes times to review all the applicants. As we know time is crucial because when the applicants wait for a long time and do not receive any feedback, they may search for other job opportunity.

Break Stalin Destalinization: A Wise Political Strategy Although many of his ideas did not bring the expected results, Nikita Khrushchev policies of de-Stalinization were politically wise. He went against many of Stalin’s tyrannical policies and gave the people a much greater sense of freedom. In the process known as “de-Stalinization';, legal procedures were restored, some greater degree of meaningful public controversy was permitted, forced labor camps were closed and the secret police tactics of Stalin’s era were erased. Stalin’s method of personal rule was replaced by group rule and more orderly processes of government, the terror apparatus was largely dismantled, the economy was notably modernized and foreign policy was conducted with much greater diplomatic initiative and flexibility. There was free political discussion, a standard forty-hour work week where people were free to change jobs, better government planning on production, and eased travel re strictions over the “Iron Curtain';. In the process of de-Stalinization the cities that were once named in honor of Stalin were given new names or returned to their old names1. The statues and pictures of Stalin were destroyed and letters were sent to families of those who were killed in battle, which criticized Stalin’s weak leadership during the time of the war. Stalin’s grave was vandalized during this process, and Khrushchev gained approval from the West. These policies were used to erase the past and ease the minds of those who suffered under the dictator2. Khrushchev worked to denounce his former leaders doings and clean up the image of the nation on a worldwide scale. Khrushchev worked hard to be agreeable with the majority of people he ruled. He sought to contrast his own present policies with the extremities of Stalinism, and therefore restore public confidence in the Soviet system.3 Perhaps the most notable example of de-Stalinization was wher e Khrushchev denounced Stalin and criticized the dictator along with those who agreed with his views. Of Mice and Men Characters Essay

In the novel, Candy and Curley’s wife play a large part of the ideas that Steinbeck wants to convey through â€Å"Of Mice and Men†. Steinbeck shows this via the events and treatments that these two characters undergo. Their speech and actions also indicate major themes in the world they were in and how desperate the era was. Candy presents an element on the sadness in the novel; he’s a unfortunate man who’s passed his expiry date. He’s been involved in an accident and lost his arm and by this, he has been reduced to the swamper of the rank- a very low status job. Steinbeck may specifically choose this job for candy as a swamper (a cleaner) tends to be a job that woman generally work as and in this job, they often gossip a lot like Candy does. He does this as it is the only pleasure that he can experience in his sad rotting life. This paints the portrait of how sad Candy’s background may be and soon this is elaborated on even more in future events. In the middle section of the book, we see how Candy is bullied by Carlson into having his best friend- his dog put down. We know that Candy is very close to his dog as Steinbeck actually chooses to describe the dog very similarly to Candy. They are both old, physically impaired and get described generally as a liability. Steinbeck chooses to describe the dog as â€Å"ancient† which produces strong imagery of a dog being similar to an old antique. Although it may possess positive connotations, it is obvious due to Carlson’s reaction that the dog is old, dirty and has no purpose anymore. Soon after as Carlson enforces the idea, Candy desperately tries to dismiss it. It states how he looked â€Å"helplessly† which shows how reluctant he is but knows there is no other possible outcome. Carlson even shows utter disrespect to his dog by pointing at it with his â€Å"toe†. By using his tower, he suggests that the dog is on par with the lowliest part of his body and doesn’t require the effort to use his hands. Nevertheless, Candy shows no aggression to this outrageous act and concedes to Carlson’s insensitive actions. Steinbeck may choose these chain of events to show how a cruel world the characters and people had to live in. It really puts forward survival of the fittest and shows how depressingly cheap life is since people can easily walk over you when you’re unable to fight for yourself. Even after all the abuse he has received, Candy is still able to show kindness to others. At the point where Candy overhears George’s dream, he slowly asks whether he can join them. We know that he isn’t greedy at this point since he repeatedly mentions how he would willingly try his best with jobs such as â€Å"cook† or â€Å"hoe† despite he â€Å"ain’t much good.† He also says how he is willing to give up all his money he received when he â€Å"los'† his â€Å"hand† and this just shows how he is desperately giving all he has to help them only for a little in return. Steinbeck emphasises how emotionally willing Candy is that he would trade in the compensation for something irreplaceable to him for the benefit of others. This makes the reader sympathize with Candy and understand how strong dreams are in life; how they give people hope, the strength to keep living and the strength to be a nice person again. Curley’s wife on the other hand is the complete opposite. Her story plays a large part in the novel as it shows how dreams can crush people’s hope as easily and they give people hope. Throughout the novel, we have always seen Curley’s wife as the problem. She is described as â€Å"poison† and â€Å"jailbait† by George which initially makes readers dislike her. We feel that she can cause the downfall of our newly made friend’s dreams so she is instantly given a hostility status by Steinbeck. However, he may deliberately do this to create a larger impact when we learn why she may possibly act the way she does. At earlier stages of the novel, we learn how Curley’s wife loves and seeks attention. Steinbeck describes how she was â€Å"standing† at the doorway blocking off the â€Å"sunshine in the doorway† deliberately. This implies that she wants the men in the bunkhouse to look up due to the sudden change as she purposefully blocks the light off so that they would do so. It also describes how she was â€Å"heavily made up† that she was making a large effort to attract attention of the men. The word â€Å"heavily† also has connotations that she was trying to hard to an extent where it had negative effects on her. This may also symbolize her character through physical features- that her personality has been corrupted and turned ugly. In the final stages of the book, we learn what has driven Curley’s wife to act in this aggressive way. Although she speaks to groups of men with hostility, when its one on one, it runs a lot more smoothly and she seems like she enjoys herself. This has a large contract since there is juxtaposition between section 4 and 5. We see her nasty side where she mock George, Lennie and Candy’s dream calling it â€Å"baloney† and â€Å"scoffs at it† yet even herself who has been crushed by her own dream may â€Å"secretly believe†. This shows that beneath this angry cover of hers, may be a vulnerable person who only feels the bitterness and jealousy of other’s happiness hinted by the phrase â€Å"secretly believe†. Steinbeck states this about the cowboy magazines to suggest what type of sad life people live in however, within dreams still lies hope but people are afraid to admit to the hope since they are scared of the criticism others show. This idea is developed implicitly mainly by the word â€Å"secret†. Through this attitude, people have become cynical and cold over the time which is what Steinbeck may want to show us. Curley’s wife shares with Lennie her dream in section 5. The fact that she has never told anyone (which she states herself) shows how underneath all the bitterness she has experienced, the memory of the dream she once had (or partially may still have) changes her to be kind and share her deepest secrets with a stranger. On the other hand, Lennie may be an exception since he is â€Å"nuts† implying that he may be able to keep this secret. Furthermore, we learn how Curley’s wife left home since she had a hunch that her mother â€Å"stole† her letters. The word â€Å"stole† in this context possesses quite negative connotations since Curley’s wife directly accuses her own mother for betraying her. However, this was most likely an excuse and lie to herself since she couldn’t bear the reality of having her dream crushed by the stranger who created it. This yet again emphasises how strong dreams were at this time which broke lives altogether. The two female speakers in â€Å"Havisham† and â€Å"The laboratory† both are presented as rather mentally unstable people. The speaker in â€Å"Havisham† is shown to have rotted away being devoured by her bitterness whereas the speaker in â€Å"Lab† seemed to be slightly more insane driven by her jealous feelings of insecurity to try and kill someone. The bitterness from the character in â€Å"Havisham† is clear from the start. She describes the man who left her as a â€Å"beloved sweetheart bastard†. This use of oxymoron shows several possible connotations. By putting two very opposite words together- one stating strong affection and one stating utter most hate, the idea that beneath the hate she holds against him lies love for him. Elaborating on this may suggest how she may hate him as she can’t have him or even because she actually still loves him deep inside. Above all, this suggests how she can’t seem to let go of him and move on which presents her mental state to the readers. Likewise in â€Å"Lab†, we understand the feelings of the speaker through clever use of language. For instance, Robert Browning chooses to say â€Å"devil’s smithy†. Devil automatically conjures the sense of evil or corruptness whereas a smithy is somewhere where things are made such as weapons (blacksmith). These combined imply that a creation of evil with malicious intent is occurring in the poem. Soon after we discover that the protagonist has experienced similar rejection to that of â€Å"Havisham†. â€Å"He is with her† suggests that the man he wants is with another woman. By referring to them as â€Å"he† and â€Å"her†, it creates an enigmatic feeling or even that their names are insignificant and it is purely the concept that she has been left for a woman who is better than her which causes her rage. We know that she is also jealous when the speaker wishes for the other woman â€Å"breast and her arms and her hands† to â€Å"drop dead†. She specifically chooses these body parts implying that these are the parts which the other women best her at and this is why she hates them. In â€Å"Havisham†, the speakers reaction to this rejection was simply to rot with it burning them. She continues to feel this bitterness as suggested with the word â€Å"Spinster†. This word possesses a harsh consonance sound as if she spits it out with such disgust. It is also a one word sentence which emphasises it and also makes it out to be some what of an insult. The word â€Å"stink and remember† following afterwards reinforces this as if she’s being driven crazy by the thought of people calling her a â€Å"spinster†. Thus all she does for the rest of her days is rot in her hate. We get the impression that she’s been doing this for years since she describes how her â€Å"dress yellowing†- yellowing suggesting dirtying from the years it’s been on her. On the otherhand, the speaker is â€Å"Lab† is made out to be more malicious than having thoughts of hate. As she makes the poison, she describes the creation with very vivid verbal details. â€Å"Grind away, moisten and mash up† create strong imagery and each of the verbs hold strong care in creating something. By suggesting this care and importance that has gone into the poison, it seems that she really relishes the creation. And finally as she fantasises about how delicious the event would be, she thinks about how the â€Å"dying face† would be â€Å"branded† into the male characters mind. She wants to mentally scar him with the horrendous image possibly for punishment or to make him see how ugly the other woman is when she becomes â€Å"shrivelled† suggesting how her face would become contorted with agony. As she describes this with such detail and precision, the poet presents to us how malicious and bitter the speaker is. A thus through use of language and theme, the poets have successfully produces a very clear image of the bitter, hate filled speakers and how they’ve become this way and even how they have dealt with this. The speaker in â€Å"Havisham† rotting and â€Å"yellowing† opposed to the â€Å"minion† in â€Å"Lab† who relishes in the thought of killing and branding someone with the scarring image of death.

In order to understand how the American government works, one must address the questions, who governs and for what purpose. However, the obvious answer may not be the correct one. Many may think that those who govern are the people or perhaps politicians. In actuality, there is no definite individual or particular group who governs. Instead governing is a process, which involves several groups (voters, candidates, parties, executive officials etc) who carry out the policies of the people by bargaining, supporting, and compromising. The purpose of those who govern is to bind society in law. The Constitution provides legitimacy for the government’s purpose, ensuring the rights of the people, as well as, protecting those who are governed from being dominated by those in power. One of the most important components of the American government is democracy. Democracy is relevant to who governs because it shows that one individual does not govern and although â€Å"the people† may elect someone, the process of getting there and the process of staying there involves other institutions that prevent too much power. Democracy involves political participation, voting, and citizen participation. Thus, one can say that every institution or individual governs in various ways and for different purposes. The American government follows Participatory democracy or representative democracy. The president is elected to serve the interests of the people. He represents the will of the majority, just as the title suggests. He is authorized to make decisions, but he alone does not have full control. In an essay concerning civil government, John Locke describes how a government functions. According to him, the only way a government can exist is when the people individually consent to the power of the government under majority rule. In order for a government to exist the people must submit to the government (if not there would be no government). The Constitution provides a similar explanation but not entirely. The Constitution creates a system of separate institutions (or branches) that share powers. The presid ent makes up the executive branch. Those eligible for voting contribute to choosing the president. The Electoral College votes also and chooses the president. The president has certain powers like being commander in chief, making treaties, etc. However, Congress and the Courts (or the legislative and judicial branches) can check his powers. Congress can refuse to pas a bill the president wants, use impeachment powers, refusing to ratify treaties, or passing laws over the president’s veto. The Courts can also check the president by declaring to be unconstitutional. Similarly the Courts can check Congress and vice versa. Each branch uses its power to help pass policies. The question of who governs is not only limited to those who fall into the category of the three branches. Several institutions of influence and monetary dominance take part in the government. Many corporations govern in their own way by funding campaigns. They use their involvement to help carry out policies that perhaps can or will benefit them. Thus, the question of who governs is vague. The Constitution focus on the 3 branches, but governing is not limited to the national government. When addressing the question to what ends or for what purpose one governs, one can say that the purpose of the government is to make decisions and laws, provide for the welfare of the people and ensure their rights. The Bill of Rights is an example of one of the purposes of the government. It states individual rights and liberties. The Constitution gives certain rights to the branches and those rights should be used for the people. Others may argue that those who govern have a special interest. It is human nature to have such instincts. However, this brings us back to the purpose of checks and balances and separation of powers. Governments govern for the majority because they represent these people (this doesn’t mean that they always serve in the best interest of the body politic). Addressing the questions is a difficult task. The answer to the question varies based on ones perspective. All About Sadie Hawkins Day Sadie Hawkins Day is a holiday that turns the tables on male/female relationships as women take the lead in pursuing men. Named after a fictional character, Sadie Hawkins Day celebrates role reversal by sanctioning women to ask men out on a date or even propose marriage. The level of comprehension that the Greeks had was astonishing. They were the first to fully understand the pyramid. The invention of the Pythagorean theorem was brilliant. Great ads to geometry were made. They also began trigonometry. Islamic Mathematics date back to ninth century A.D, Indian people were already performing algebra problems. Muslims also expanded the theory of numbers, and explained many ways of solving equations. They were also responsible for the expansion of Math in the West (to Europe). The Renaissance Mathematics was a period of many great discoveries. For one, Infinity had begun to be used in the end of the 15th century and beginning of the 16th century (A.D of coarse). There was also discoveries of algebraic solutions to cubic and quadratic equations. The Renaissance also gave way to the beginning of algebraic symbolism: a + b = c. Brigadier General Adolph von Steinwehin the Civil War Adolph von Steinwehr - Early Life: Born at Blankenburg, Brunswick (Germany) on September 25, 1822, Adolph von Steinwehr was a member of a long-standing military family.   Following in these footsteps, which included a grandfather who had fought in the Napoleonic Wars, Steinwehr entered the Brunswick Military Academy.   Graduating in 1841, he received a commission as a lieutenant in the Brunswick Army.   Serving for six years, Steinwehr grew dissatisfied and elected to move to the United States in 1847.   Arriving at Mobile, AL, he found employment as an engineer with the US Coastal Survey.   As the the Mexican-American War was underway, Steinwehr sought a position with a combat unit but was declined.   Disappointed, decided to return to Brunswick two years later with his American-born wife, Florence Mary. Adolph von Steinwehr - The Civil War Begins: Again finding life in Germany not to his liking, Steinwehr permanently immigrated to the United States in 1854.   Initially settling in Wallingford, CT, he later moved to a farm in New York.   Active in the German-America community, Steinwehr proved well-placed to raise a largely German regiment when the Civil War began in April 1861.   Organizing the 29th New York Volunteer Infantry, he was commissioned as the regiments colonel in June.   Reporting to Washington, DC that summer, Steinwehrs regiment was assigned to Colonel Dixon S. Miles division in Brigadier General Irvin McDowells Army of Northeastern Virginia.   In this assignment, his men took part in the Union defeat at the First Battle of Bull Run on July 21.   Held in reserve during much of the fighting, the regiment later helped cover the Union retreat.    Noted as a competent officer, Steinwehr received a promotion to brigadier general on October 12 and orders to assumed command of a brigade in Brigadier General Louis Blenkers division in the Army of the Potomac.   This assignment proved short-lived as the Blenkers division was soon transferred to western Virginia for service in Major General John C.  Frà ©monts Mountain Department.   In the spring of 1862, Steinwehrs men took part in operations against Major General Thomas Stonewall Jacksons forces in the Shenandoah Valley.   This saw them defeated at Cross Keys on June 8.   Later in the month, Steinwehrs men were moved east to help form Major General Franz Sigels I Corps of Major General John Popes Army of Virginia.   In this new formation, he was elevated to lead the Second Division.   Ã‚      Adolph von Steinwehr - Divisional Command: In late August, Steinwehrs division was present at the Second Battle of Manassas though was not heavily engaged.   Following the Union defeat, Sigels corps was ordered to remain outside of Washington, DC while the bulk of the Army of the Potomac moved north in pursuit of General Robert E. Lees Army of Northern Virginia.   As a result, it missed the Battle of South Mountain and Antietam.   During this time, Sigels force was re-designated XI Corps.   Later that fall, Steinwehrs division moved south to join the army outside Fredericksburg, but played no role in the battle.   The following February, following Major General Joseph Hookers ascent to lead the army, Sigel left XI Corps and was replaced by Major General Oliver O. Howard. Returning to combat in May, Steinwehrs division and the rest of XI Corps were badly routed by Jackson during the Battle of Chancellorsville.   Despite this, Steinwehrs personal performance was commended by his fellow Union officers.   As Lee moved north invade Pennsylvania in June, XI Corps followed in pursuit.   Arriving at the Battle of Gettysburg on July 1, Howard directed Steinwehrs division to remain in reserve on Cemetery Hill while he deployed the rest of the corps north of town in support of the late  Major General John F. Reynolds I Corps.   Later in the day, XI Corps collapsed under Confederate assaults leading the entire Union line to fall back on Steinwehrs position.   The next day, Steinwehrs men aided in repelling enemy attacks against East Cemetery Hill.    Adolph von Steinwehr- In the West: Late that September, the bulk of XI Corps along with elements of XII Corps, received orders to shift west to Tennessee.   Led by Hooker, this combined force moved to relieve the besieged Army of the Cumberland at Chattanooga.   On October 28-29, Steinwehrs men fought well in the Union victory at the Battle of Wauhatchie.   The following month, one of his brigades, led by Colonel Adolphus Buschbeck, supported Major General William T. Sherman during the Battle of Chattanooga.   Retaining leadership of his division through the winter, Steinwehr was dismayed when XI Corps and XII Corps were combined in April 1864.   As part of this reorganization, he lost his command as the two formations were consolidated.   Offered command of a brigade, Steinwehr refused to accept a tacit demotion and instead spent the rest of the war in staff and garrison posts. The Strategic Importance of the Battle of Fort Donelson - Research Paper Example John Thayer became the leader of the Nebraska regiment. The regiment spent time in Missouri with General John Fremont in preparation for the war. The regiment marched directly through St. Louis where it was reported that several people thronged by the road to witness their hero. In December, the troops were under a constabulary duty to defend their state. The State had experienced some defeats earlier in August and this had caused many fears to the State. To defend them, the State waged a tactical guerilla war and bushwalking to counter their enemies. Major General Sterling Price had managed to confide all the southern in Missouri State with the aid of union forces (Cooling 2003). This force joined another union under the control of Major Brig and Gen. John Pope who struggled to restore peace and order in the northern part. As a trial, the Nebraska participated in a skirmish at Shawnee mound on the Black River. The union managed to capture other hundreds of confederates and the warmo ngers were appreciated for their efforts. By this time, the troupe now was ready for the campaign in 1862. In January 1862, Gen. Ulysses Grant commanded a garrison at Kentucky and convinced the commander of Missouri Gen. Henry Halleck that they were to break the western defense force in order to conquer that State. In this regard, first Donelson, which was near River Tennessee were the weakest and most attractive link between Mississippi and Cumberland Gap. Grant won the support from Andrew Foote and the two launched a strong army, which were determined to win this confederate and bring it under their control. Grant had fears that his troop had few men and thus he had to strengthen his army before he made any move (Palagruto 2010). He used two methods to reinforce his troops as he first stripped his department and eliminated any regiment that could arise as opponent to his mission and secondly, Hallenick made orders that could forward the zealous and untested the Nebraska in order t o test the strength of Nebraska. The Nebraskans boarded a train to St. Louis while the regiment group opted for a steamer train to transport them to join Grant’s troop. Several groups started to arrive at fort Henry and Grant immediately ordered these boats to move further to Cumberland where they could carry out their operations. This was meant to reinforce grant’s operations in fort Donelson. The heavy February rains in the area dismantled transportation along the rivers and at the same time Grant’s troop were facing opposition from stubborn defenders at fort Donelson. The port was not easily conquered as it had several creeks, heavy woods, ravines, and the current floods. The Tennessean fighters were out to defend their land and they managed to guard their guard (Palagruto, 2010). The confederates understood that Tennessee, Mississippi, and Cumberland River were the vital targets by the rebel forces. Thus, they could not allow them to access this area for it linked the North and the South. In addition, the rivers were a major means of transport between the two states that is the South and the North. The Southerners struggled all their best to defend these rivers as the North could easily attack them. The Plague of Plagiarism      Ã‚  Ã‚   Simply defined, the word plagiarism means "the unauthorized use of the language and thoughts of another author and the representation of them as one's own" ("Plagiarism").   While many students understand and comprehend the first clause of this definition, many encounter problems with the second part - the thoughts part.   Many students in today's educational system are frequently unable to develop their own thoughts, opinions, and ideas relating to the subject matter that they are studying.   However, when people at a university are educated according to the ways set forth by John Henry Newman in "The Idea of a University," their ability to create original concepts would be cultivated to the point, where they do not feel the need to plagiarize and cheat.   Newman also states that in the end, the university will produce citizens that can give back to society (48).   Jeffrey Hart makes a similar point in "How to Get a College Education."   Therefo re, according to both Newman and Hart, an honest person will be fashioned by the university.   Since honesty does not breed cheating, should not cheating then be minimized?   Plagiarism and its sister cheating are plagues on society that only serve to corrupt it.   Nevertheless, the education given by a university can diminish and, perhaps, even eradicate the disease by instilling in students,   a sense of honor, and implementing harsh penalties on those caught cheating or plagiarizing.      Ã‚  Ã‚  Ã‚  Ã‚   The fostering of independent thought is sometimes forgone in today's educational system. Tortilla Curtain: Jack Jardine Jack Jardine is a very interesting character in the story Tortilla Curtain. He has a very strong influence on Delany Mossbacher, one of the central characters in the story. His influences, along with the tragic string of events concerning Delany and Candido, produce a complete turn around in the ideals of Delany by the end of the story. At the start of the story Delany is a 'liberal humanist';, albeit a hypocritical one, but by the end of the story Delany is carrying a gun looking for Candido. It is easy for readers to categorize Jack as a cruel, cold hearted, upper class bigot considering his actions and words. I have to admit I think he comes off that way sometimes. But he also is a lot more than just that. He isn't stupid. In many ways his reasoning about illegal immigrants makes a lot of sense. Illegal immigration does hurt the economy. Illegal immigrants do take away jobs from citizens. But Jack takes it to such an extreme that it is hard for one to feel that his views of illegal immigrants and his sentiments about them are purely a result of his concern about the economy and the state. 'Don't be surprised, because this is only the beginning. We're under siege here-and there's going to be a backlash.';(pg. 146) Jack acts like citizens are in some kind of war with illegal immigrants. Discuss the drawback of the jury system as it is implemented in the UK

Introduction A jury in the UK generally consists of 12 randomly selected lay people that have been sworn conduct an impartial verdict as to whether a defendant is guilty or not guilty in a criminal trial. The objective of the jury system is to provide a just and fair outcome that could not otherwise be achieved by judges alone (Lesser, 2010: 12). It is believed that if judges acted alone, the decision would be a prejudicial, which would create unfairness. The human rights of the individual concerned would also be violated (Human Rights Act 1998, giving effect to the European Convention on Human Rights 1951). The most import concept of having a juror give a verdict is that juries may acquit a defendant in situations where a guilty verdict is demanded by the law (Elliott and Quinn, 2010: 233). An example of this can be seen in the case of R v Wang [2005] UKHL 9 where it was made clear by the House of Lords that a judge can never instruct a jury to convict a defendant. The jury system is therefore c onsidered an important part of the confidence society has in the criminal justice system. The Juries Act 1974 is the main governing legislation that regulates the jury system by signifying what persons are eligible for jury service as well as making provision for the right to challenge jurors. The Criminal Justice Act (CJA) 2003 is also capable of restricting the role of the jury by imposing further limitations on the eligibility criteria and by allowing trial by judge alone in certain circumstances. Whether these limitations are necessary is arguable, but it has been said that the jury is an outmoded institution that needs to be reformed. In light of this, the drawbacks to the jury system in the UK will be discussed in this study. Trial by Jury The jury system in the UK is highly controversial because on the one hand, juries are considered to provide important protection for citizens (Gastil et al; 2002: 585), whilst on the other they are considered to be costly, time consuming and unable to deal effectively with complex cases (Gastil and Weiser, 2006: 6). In addition, it has also been said that the jury system in the UK is outmoded and ineffective and that it should be abolished (Baksi, 2014: 1). Essentially, because juries are not being used as frequently as they once were, it is questionable whether they are in fact still needed (Zander, 2007: 157). In the majority of instances, a jury is not needed as a defendant will have submitted a guilty plea, yet in those instances where a not guilty plea has been entered, it has been said that juries are essential in ensuring that a fair trial is provided to the defendant under Article 6 of the ECHR and in the interests of justice. This was recognised by Thomas and Balmer when it was pointed out that; â€Å"there is an ancient right for an accused to be tried only by the lawful judgement of his equals or by the law of the land and even though there is no modern constitutional right to trial by jury in England and Wales, governments have found the public extremely unwilling to sanction further restrictions to jury trials† (2007: 1). This highlights the significance of jury trials and whilst there are many drawbacks, it is widely accepted that juries help to maintain justice. Conversely, it is believed by some that jury trials should be eradicated on the basis that they are largely ineffective on the basis that judges have a strong influence over the outcome of the trial (Stone and Dennis, 2003: 2). This was identified by Sanders and Young when it was evidenced that even though it is left to the jury to decide, beyond reasonable doubt, whether or not a defendant is guilty, â€Å"judges often exert a strong influence on the outcome and are far from being the passive impartial referee as depicted in adversarial theory†(2006; 496). Because of the influence judges exert over juries, it seems as though the jury system is a waste of time and expense. Furthermore, because juries do not have to give a reason for their decision, it is difficult to tell whether a just decision has been provided anyway as the decision may not be based upon their own findings and may instead be based on the judges influence. In view of this, the Auld Report found that; â€Å"many contributors have suggested that the system may not, as a matter of English law, withstand a challenge, that the unreasoned jury verdict violates article 6.† It is questionable whether this does violate article 6, ye t it was made clear in Condron v UK (2000) 31 EHRR 1 that it is not. Therefore, even though jurors do not have to provide a reason for decisions reached, it is said that a fair trial is still being provided. This does not seem fair, since a violation of Article 6 would be found if a judge failed to provide a reason, yet this is not the case for jurors. As stressed by Doran; â€Å"trial by jury occupies a pivotal yet paradoxical position at the centre of the English criminal justice system† (2002; 379). Arguably, it is clear from this that many do actually favour jury trials and are of the view that an effective justice system is being attained. However, because jury trials are not used in serious and complex fraud trials, it is arguable whether jurors are well equipped to deal with all other trials. The inability of jurors to deal with such cases was introduced by the CJA 2003 and emerged from the Jubilee Line Jurors [2007] Crim LR 255 case. Here. jurors suffered serious personal difficulties because of the complexity of the issues at hand (Lloyd-Bostock: 2007: 1). In cases such as this, it is more desirable for a judge-only trial to be conducted, yet it could be said that this should apply to all trials and not just those that have a complex nature. Moreover, the fact that trial by jury has been abandoned in other jurisdictions seems to demonstrate that the jury service is unworkable and ineffective. This has exemplified by Laville (2010: 1) who put forward that; â€Å"in the last 400 years, trials without juries have taken place in Northern Ireland, where the Diplock courts were set up to provide justice in the intimidat ing atmosphere of the Troubles.† Consequently, it could be said that Northern Ireland are aware of the difficulties and uncertainties of jury trials and have therefore made the decision to abandoning them. Juries were also discarded in Germany on the 4th January 1924 when it became apparent that injustice frequently occurred as a result of jury trials. This was identified by Herzog when it was noted that; â€Å"since 1924 jury trials have been abolished in Germany and there are no signs of a renaissance of lay participation and jury trial in the German criminal justice system† (2012: 1). It is arguable whether this demonstrates the ineffectiveness of jury systems but it is evident that the Germans do not agree with them. Jury trials were also abandoned in India following the case of K.M. Nanavati v State of Maharashtra [1962] Suppl 1 SCR 567 where it became clear that juror’s decisions were capable of being influenced by the media and the public. As put by Debroy; â€Å"the Nanavati case was responsible for abolition of jury trials in India and it was the last trial by jury† (2009: 1). It was also identified by Debroy that there is a correlation in India between the abolishment of jury trials and the prolonging of cases (2009: 2). In view of this, it cannot be said that jury trials should be completely abolished in the UK as cases may actually be prolonged as a result and there are various safeguards that have been implemented so as to ensure juries are not being influenced by the media and the public (Rackstraw, 2008: 726). Therefore, whilst jury systems do create difficulties, it cannot be said that they should be completely discarded as a result as they are still considered a vital p art of the justice system. Furthermore, if jury trials were abolished it is likely that this would result in prolonged trials as is the case in India. Furthermore, judges would also be capable of producing prejudicial decisions, which would ultimately contravene Article 6 of the ECHR which provides for a defendants rights to a fair trial. In a study that was conducted by Sturcke, it was found that; two in three jurors did not fully understand the legal directions and that more than one in 10 jurors carried out their own investigations online about a case (2010: 1). This study was based on 69,000 cases over a two-year period, which highlights the injustices that can actually be caused by a jury trial. This seems to provide a strong argument as to why jury trials should be abolished, however problems will still be caused by judge alone trials. In effect, it appears as though there ought to be a balance so that juries do remain, yet where cases are likely to be prejudiced a judge alone trial should be conducted. Essentially, this is what seems to be happening at present as jury trials are being discarded in serious and complex fraud cases, yet whether this scope should be broadened to allow for their elimination in other cases is likely. This will ensure that juries are maintained, on the one hand, whilst also enabling them to be discarded in cases which would be difficult for them to cope with. Whether this means that there will be an effective jury system in place, is however arguable. Conclusion Overall, there are many underlying difficulties which emerge from a trial by jury, yet it cannot be said that they should be completely eradicated.
